One measure of a litigator is whether he or she is capable of "trying the case". Even clients who want their matters to settle quickly need a lawyer who is known for excellent trial ability in order to gain advantage in the settlement process.
One measure for determining whether a litigator can try cases successfully is to review the extent to which the litigator and the firm have participated in cases decided by published decisions, particularly decisions published by the Appellate Court and Supreme Court.
